Liabilities of distributors

A distributor is responsible when placing on the market a cosmetic product under their own name or trademark or if modifying a product which is already on the market by impacting its compliance with applicable requirements. A translation of information on a cosmetic product which is already on the market is not considered a change in compliance.

The distributor must ensure that:

  • the cosmetic product is labelled accordingly;
  • all language-related requirements are met;
  • the minimum expiry date of the cosmetic product has not passed;
  • storage and transport conditions do not threaten its compliance, and that serious adverse effects of the cosmetic product are being reported on.
